Abstract

In recent years, India has witnessed a sharp rise in false matrimonial litigations, particularly 498A of the IPC and related Domestic Laws for under the Protection of Women’s. These laws were introduced to safeguard women from cruelty and abuse, their misuse by both genders led to significant injustice, social stigma and misuse of judicial resources. This paper critically analyses the root causes, acceptability and tolerance of such false cases by the Indian legal and judicial system and society. It explores how professional ethics, judicial discretion, and systemic delays contribute to the problem. Also trying to closely understand the current effect of false litigations on people, nations and society and make assumptions of long and short term impacts. The study argues for the urgent need to balance gender justice with fairness to all parties, calling for legal reforms, stricter scrutiny, and ethical responsibility across the justice system to preserve the integrity of matrimonial law in India.
